Sistema de Justiça no Brasil: Problemas de Eqüidade e Efetividade

Abstract: Este estudo versa sobre o sistema de Justiça no Brasil - sua estrutura e sua dinâmica, do início dos anos 1990 até o momento atual. Em primeiro lugar, apresentam-se alguns problemas desse sistema, principalmente a iniqüidade e a inefetividade do acesso da população aos serviços jurisdicionais. As razões desses problemas estão ligadas não só à demanda por tais serviços no país, mas também à sua oferta. Em segundo lugar, descrevem-se as iniciativas de solução desses problemas, especialmente aquelas situadas no plano legislativo. O destaque vai para a reforma efetuada pela Emenda Constitucional no 45/2004, que abriu espaço para outra, de caráter infraconstitucional. Como será examinado, tal reforma tendeu a balancear a demanda pelos serviços jurisdicionais, bem como favoreceu sua oferta mais célere, imparcial e certa. The purpose of this study is to analyze the system of Justice in Brazil - its structure and its dynamic, from the beginning of 90?ies until now. Firstly, there is a description of some of the problems of this system, mainly the iniquity and the ineffectiveness of the access to jurisdictional services. These problems are related, at the same time, to the supply and demand of these services. Secondly, there is a presentation of the initiatives to solve these problems, specially legislative ones. This study focus in Constitucional Amandment nº 45/2004, as well as in complementary laws. As will be examined, this legislation favoured a more balanced demand for jurisdictional services and, on the other side, a faster, more impartial and secure supply.
