Abstract: In comparative legal material considered major current challenges experienced by the mortgagee the right to take priority (priority): competition to ensure surrogate ways obligations that either enhance the creditor's rights, bringing them to the right of ownership or control of the lender extend over the debtor's property. Particular attention is paid to the protection of priority mortgagee debtor in bankruptcy from unexpected collateral and from bona fide applicants for empty-lien.
