Abstract: Characterization or classification of a given factual situation is one of the necessary steps in the decision of a case having some foreign elements. Yet, despite a capacious literature existing on the subject, the problem of characterization is one of the most complicated problems of the private international law. Such is the diversity in the laws of various countries of the world. In modern era, characterization appears to be an impenetrable problem.
