Conceptual and legal analysis of the criminal-procedural concept of "victim"

Anastasia S. Lukomskaya ()

RSUH/RGGU BULLETIN. Series Economics. Management. Law, 2018, issue 1

Abstract: The article is devoted to the linguistic-historical and functionalpragmatic study of the criminal-procedural concept «victim». Particular attention is paid to the formulation, explanation and theoretical description of its most complete primary semantic content and meaning. The author makes an attempt to analyze existing norms of the substantive and procedural law, what showed that the category «victim» has an intersectoral character and represents a dynamic system consisting of theoretical and practical generalizations that reflect the concept of reality using legal concepts-abstractions: "injured party", "victim", "sufferer". These concepts form the core of the concept of the general legal category "victim".
