Registration of transfer of ownership rights to real estate. Issues and prospects

Abstract:
Thе article deals with improving the procedure for registering the transfer of real estate rights in Russia in the context of digitalization. The digitalization of public services has been going on for more than 10 years, and the sphere of real estate registration is no exception. Of considerable interest is the correlation of public law regulation of the government registration of real estate with private law regulation in the field of real estate transactions, as well as with basic civil law principles, in particular, with the principles of reasonableness and good faith, freedom of contract. In connection with the digitalization of public services, the issue of protecting personal data is becoming more relevant than ever: it gives rise to many discussions, becomes the reason for the reform of various legislative acts. In the study, the author a sets out to establish an optimal balance between measures aimed at protecting personal data and civil freedom, the unlimited use of modern technologies. The article analyzes the main trends in the legislation governing the registration of ownership of real estate, analyzes its challenges and draws conclusions regarding its possible prospects. It also studies a number of doctrinal sources on the issue and gives the positions of other scientists in the field of law. The conclusion contains both general provisions and a specific proposal for improving the legislative regulation of government registration of real estate.
