THE 2018’S NATIONAL CONGRESS LEGISLATIVE ACTIVITY UNDER THE LENS OF ECONOMIC FREEDOM

Abstract: The present work has an objective to make a descriptive and analytical study on Brazilian national congress legislate activities’ in 2018 focusing in how these activities affect the free initiative and the possibilities of exchanges of property rights by market institutions. The legislative process and the set of projects and laws that of it emanate are part of the rules of the game, that is, of the institutional landmark of the country. Thus, in order to elaborate the analytical categories, the following steps are made: 1) a literature review on political, sociological and economic institutional theories; 2) the use of the Economic Freedom Index from Fraser Institute as a pointer of the institutional quality of the countries. It was made a random selection of 1286 law projects that had moved in at least one of the houses of Brazilian national congress, during the last year of the 55ª legislature, 2018. The content of law projects is analyzed to identify possible mismatches with any aspect of the economic freedom. The results show that more than 50% of presented proposals and almost 65% of the proposals voted, amongst the analyzed ones, intervene in at least a dimension of economic freedom. Results also demonstrate that these proposals have no relation with regional origin or political party affiliation.
