The Institutional Compliance of the Criminal Liability Deprivation Accordingly to the Constitutional Principle of the Presumption of Innocense: The Comparative and Legal Approach

Abstract: Article deals with the question as to accordance of institution of relief from criminal responsibility and constitutional principle of presumption of innocence. The author applies comparative-law approach and draws a negative conclusion. He suggests to renounce from this institution in the Criminal Code and the Code of Criminal Procedure of Ukraine, improving institution of relief from punishment and serving thereof in CC and also institution of shutting of criminal conducting in CCP of Ukraine with using of foreign legislation experience.
