The Supply Contract

Abstract: The supply operation is widely used among professionals, which is why it has imposed the regulation of the relations between them. The supply contract complements the provisions of the sales contract, concerning the effects of the contract, specifically the obligations of the parties: those of the supplier, namely the transfer of ownership of the supplied goods, delivery of goods and provision of services, bearing the risk of loss of the goods up until they are handed over, the warranty obligation for eviction, and the warranty obligation for the defects of the supplied goods, as well as those of the beneficiary, namely taking over the goods and paying the price of the products or services. An aspect that adds specificity to the supply contract is the possibility of subcontracting the supply, which, we believe, raises issues due to the lack of regulation regarding the possibility of changing the price by conventional means.
