A Study on Legislative Issues Concerning the Protection of Virtual Property in Chinese Games in the Context of the Internet

Abstract: This paper investigates legislative issues concerning the protection of virtual property in Chinese online games within the broader context of the Internet. Its primary objective is to analyze existing legislative shortcomings and propose potential pathways for improvement. Methodologically, the study adopts a qualitative, problem-solution-oriented approach, systematically examining the legal attributes and classification criteria of virtual property through case studies and comparative legal analysis. The findings reveal several practical challenges in China's current system, including the absence of specialized legislation, the lack of provisions for claiming compensation for non-pecuniary damages, unclear jurisdictional authority for disputes, and difficulties in identifying infringing parties. In response, the paper proposes enhancing systematic legal protection by improving specialized legislation, establishing a multi-stakeholder regulatory framework, implementing a virtual property registration system, and promoting real-name authentication in online games. These recommendations provide a theoretical foundation and practical reference for the future development of legislation on virtual property protection in China.
