Risk allocation issues in commercial leases – updated

Alan Di Sciullo

Corporate Real Estate Journal, 2016, vol. 6, issue 2, 145-161

Abstract: This paper continues an exploration into recent changes in casualty and insurance issues that the author first examined in a paper published in this journal in 2011 entitled ‘Risk allocation issues in commercial leases’ (JCRE, Vol. 1 No. 2, pp. 148–55 [2011]). Since then, the industry has made significant changes to the types and extent of coverage and the federal backstop (TRIA and its successors) has been extended and expanded until 2020.
