Rights of light: Parasitic injury and damages — a review
Delwyn Jones
Journal of Building Survey, Appraisal & Valuation, 2014, vol. 3, issue 2, 124-133
Abstract:
At a time when the Law Commission has initiated consultation on the law relating to rights of light, this paper focuses specifically on one aspect of associated surveying practice – the treatment of ‘parasitic injury’ in the measure of nuisance, associated compensation figures and outcomes at trial. It concludes with suggestions as to debate and reform of surveying practice that seemingly resonate with reasoning underlying the Law Commission consultation project.
