`Chaturachinda v Fairholme`: How special are special foundations now?

Abstract:
Special foundations have long been a cause for concern and/or dispute in party wall matters. The case of Chaturachinda, while only a County Court decision, is likely to remove many of those difficulties for building owners. This paper deals with the background to, substance of, and likely consequences of this important decision.
