Right to light: Is there light at the end of the tunnel for property development?
Rachel Gimson
Journal of Building Survey, Appraisal & Valuation, 2018, vol. 7, issue 1, 43-47
Abstract:
Right to light can appear so specialist that lawyers and surveyors alike avoid becoming involved in this niche area. While of course the expert analysis is specialist and the case law has developed nuances in the system, at its very base a right to light is the same as any other property right and can be established and protected in the same ways.
