Abstract: This paper explores the background to the Privacy and Electronic Communications (EC Directive) (Amendment) Regulations 2011; the major changes that have been made to the law in this area; the opt-in regime and exceptions to the general rule as well as the practical issues involved in the implementation of the regulations in the UK.
