Abstract:
This legal update looks at the House of Lords landmark decision in the Bawtry case, which considers contaminated land liability in the context of a privatised industry. This update also reviews some of the main proposals in the Housing Green Paper and the consultation paper on possible amendments to s. 237 of the Town and Country Planning Act 1990 to make it easier to override easements and other rights in the context of a Compulsory Purchase.
