Abstract:
The administrative courts have been providing useful clarifications on many of the fundamental concepts of the unfair commercial practices law. Nevertheless, they have been too deferential towards the Italian Antitrust Authority, whose decisions they have often upheld on the basis of not entirely convincing arguments.The author hopes that, in the future, administrative judges will be less hesitant in fully exercising their powers of judicial review
