Impact of Legal Aid Accessibility on Case Outcomes in Criminal Justice in India

Abstract: Purpose: The aim of the study was to assess the impact of legal aid accessibility on case outcomes in criminal justice in India. Materials and Methods: This study adopted a desk methodology. A desk study research design is commonly known as secondary data collection. This is basically collecting data from existing resources preferably because of its low cost advantage as compared to a field research. Our current study looked into already published studies and reports as the data was easily accessed through online journals and libraries. Findings: The study demonstrated that individuals who receive legal assistance are more likely to experience favorable outcomes compared to those who do not. Access to legal aid ensures that defendants are better prepared for their cases, as they benefit from the expertise of legal professionals who can navigate complex legal procedures, provide informed advice, and advocate effectively on their behalf. This often leads to more equitable treatment within the justice system, including fairer trials and, in many cases, reduced sentences or even acquittals. Moreover, the presence of legal aid can mitigate the disparities faced by marginalized communities, who might otherwise be disadvantaged due to socioeconomic factors. Studies have shown that legal aid contributes to higher rates of plea bargaining, which can result in less severe penalties and quicker resolutions, thereby reducing the overall burden on the judicial system. Implications to Theory, Practice and Policy: Legal mobilization theory, resource dependency theory and access to justice theory may be used to anchor future studies on assessing the impact of legal aid accessibility on case outcomes in criminal justice in India. Enhancing legal aid delivery models is essential for improving accessibility and effectiveness in practice. Investing in legal aid infrastructure is critical for advancing equitable access to justice.
