Performance of the high anti-corruption court as a factor in the effectiveness of the anti-corruption system

Abstract:
The study evaluates the effectiveness of the anti-corruption criminal justice system as an integrated object of public management. It identifies the High Anti-Corruption Court (HACC) as a critical systemic constraint or «bottleneck», where the court's throughput capacity directly determines the overall performance of the National Anti-Corruption Bureau and the Specialized Anti-Corruption Prosecution Office. The research argues that to ensure systemic balance and rational resource allocation, the court’s operational capacity must serve as the primary benchmark for planning pretrial investigation activities. By analyzing empirical data and employing econometric modeling, the authors reveal a significant discrepancy between the normative timeframes established by the State Judicial Administration and the actual duration of judicial proceedings. The findings indicate that the average calendar duration for first-instance trials already exceeds 1,200 days and continues to demonstrate a steady upward trend. The study pays particular attention to case classification by complexity, projecting that by 2030, the trial duration for high-complexity proceedings could exceed eight years. The scientific novelty of the research lies in the development of predictive performance indicators for the court and the justification of public management interventions needed to optimize trial processes. The authors emphasize that under current conditions, the HACC may soon face an institutional inability to resolve complex cases within reasonable timeframes. This creates a high risk of cases being dismissed due to the expiration of statutes of limitations. The study concludes that ignoring these identified trends poses a direct threat to national security. The mismatch between the current pace of justice and the public demand for swift and inevitable punishment undermines the credibility of the entire anti-corruption reform. Strategic measures in judicial time management and procedural optimization are recommended to prevent a systemic crisis in the medium term.
