The Harper Review Recommendations on Anticompetitive Agreements: Some Comments

Reviews of legislation, such as the Competition and Consumer Act 2010 (Cwlth), occur for many reasons. However, they provide an opportunity to reassess previous changes and to appraise the structural integrity of the law. This was the case in the most recent review, chaired by Professor Ian Harper, in which attention was given to the rather disjointed treatment of anti-competitive agreements. This article discusses why change is desirable and considers the implications of having a single provision that addresses such agreements.
