Law Applicable to the European Cooperative Society: special reference to the european cooperative established in Spain

Abstract:
The article deals with the problems related to the contents of Article 8 of Council Regulation (EC) No. 1435/2003 of July 22 when regulating the law applicable to a European Cooperative Society. The special role which this Article gives to national legislations not only contradicts the idea of having a European enterprise with a proper regulation independent of national laws but also creates coordination problems between European and national laws which acquire a special meaning when the European Cooperative Society is established in Spain.
