Abstract: In this article the decision of the German Federal Cartel Office to implement a so-called “No-Single-Buyer-Rule” for Bundesliga broadcasting rights is critically examined. Against the background of the competition economics literature on vertical restraints, we argue that the possibilities to solve potential competition problems by applying such a rule are very limited. Instead, our analysis suggests that the conditions imposed by the German Federal Cartel Office have a welfare-damaging effect. In any case, however, the decision on the introduction of such a “No-Single-Buyer-Rule” would have required a decided market definition and competition analysis.
