Abstract: Mit dem Urteil des dritten Zivilsenats vom 5. 10. 2023 hat der BGH seine Rechtsprechung zu den konkreten Anforderungen an das in § 307 Abs. 1 Satz 2 BGB niedergelegte Transparenzgebot für AGB-Bestimmungen um ein Beispiel aus dem Bereich der Kapitalanlageprodukte – in diesem Fall einem Investmentfonds – erweitert. Das Urteil, das im Markt nicht unübliche Kostenklauseln betraf und als überraschend streng bezeichnet werden kann, gibt auch Anlass, sich mit den Folgen der Wahl anderer europäischer Fondsdomizile für die Transparenz- und Inhaltskontrolle zu befassen. Auch zu dieser Frage gibt es erörterungswürdige Judikate aus der jüngeren Vergangenheit.
