Abstract: Der Bundesgerichtshof hat in einer kürzlich veröffentlichten Grundsatzentscheidung die bislang strittige Frage der Formbedürftigkeit des Schuldbeitritts zu einem konstitutiven Schuldanerkenntnis entschieden. Der nachfolgende Beitrag nimmt das Urteil zum Anlaß, die Formprobleme des Schuldbeitritts und des Schuldanerkenntnisses zu überdenken.
