Abstract: Paragraph 266 of the German criminal code serves as a proxy regulation for dubious eco­nomic transactions in the case of missing specific regulations. Jurisdiction and literature provide a vast array of interpretations regarding paragraph 266. In this context, embezzlement at the expense of legal persons is most significant. However, contributions regarding cooperatives are largely missing. This is quite surprising, as it does not correspond to the growing importance of the cooperative sector. This article is an attempt to close this gap.
