Abstract: In 2001 the German Federal Constitutional Court (Bundesverfassungsgericht) affirmed the compatibility of compulsory membership in a regional auditing association and freedom of association according to article 9 of the German constitution. The court’s decision is based in the traditional view that associations have to either guarantee sufficient equity capital or, as in the case of a cooperative, are subject to other control mechanisms. Since the decision of the court, this traditional view is continuously eroding thus implying a quite different perspective.
