Abstract:
This article analyzes the draft guidelines of the Federal Cartel Office (BKartA) on cooperatives and antitrust law, which were presented in May 2021. The author analyzes several topics which were addressed in the draft guidelines. Furthermore, the author deals with the new provision of Section 32c (4) ARC, which was introduced at the beginning of the year by the ARC Digitization Act. According to this, under certain conditions, the parties concerned have a right to a decision by the Office on the conformity of a planned project with antitrust law.
