Monica Ardeleanu

Manager Journal, 2007, vol. 6, issue 1, 142-150

Abstract: The presence of the normative act amongst the formal law sources system is the result of the constructive activity of specialized bodies, designated by the Constitution, by laws or by regulations of normative power (having the right of drafting norms of generally mandatory power). Such bodies are named lawgiving bodies (also referred to as the lawgiver or lawmaker) and they are first of all the bodies of the lawgiving power, entitled to issue on a primary and originator level the fundamental social relations in a society, to organize the juridical order of a nation or of a community of nations. The activity of these bodies is carried out under rules of juridical technique and in accordance with the general purposes imposed by the proper functioning of the social mechanism regarding the coexistence of social freedoms.
