Par-delà le transcendantal et le comparatif. Deux arguments

Abstract: This paper develops two arguments which question the validity of this distinction between the transcendental and the comparative approaches proposed by Sen in his last book, The Idea of Justice [2009]. Our first argument discusses Sen?s use of the concept of impartial spectator developed by Smith, while our second argument applies to the concept of capability and the subsequent polemic between Sen and Nussbaum. We show that several elements Sen considers as related to the transcendental approach are necessary for an accurate understanding of both concepts. This weakens Sen?s assertion according to which the latter belong exclusively to the comparative tradition. Therefore, this weakens the distinction itself.
