L'évolution des procédures de clémence

Abstract:
Leniency programs have become a central tool in the fight against cartels. Since they were supposed to deter cartel formation and detect existing cartels, authorities expected a great success. However, economic literature and facts have shown that leniency programs have many failures and drawbacks. That is why many modifications were operated in order to improve the efficiency of these procedures. The question is : did these modifications actually improve the leniency procedures ? If we refer to the existing and growing literature on this subject, the answer seems to be more negative than positive.
