Abstract:
This article provides a literature review that examines intellectual property rights and their effects in terms of supporting innovation and contributing to general welfare. It traces, in parallel with the move from the first globalization to another within the capitalist system of production, the subtle shift from one controversy to another between the end of the nineteenth century and the beginning of the twenty-first century: from the social utility of patents to that compulsory license.
