Abstract: By reviewing French doctrinal and judicial positions in regards of the fees applicable to the occupation of the public domain for telecommunications purposes, the foregoing note is published at a moment when « telecom» operators worry about the rate of the fees they have to pay, in particular the UMTS rights of use fees. The author notices the difference between the national regulations concerning these fees but puts in evidence a minimum EC rules applicable in this domain.
