Droit d'auteur » contra « droit de la concurrence »: versus « droit de la régulation

Abstract:
The conflict between copyright (« droit d?auteur ») and some liberties, like economic liberties, disrupts the « initial » balance of interests inside copyright (public?s interest/author?s interest). The evolution of European antitrust law overthrows the property nature of copyright, consecrating a « right of access » for users. The French approach methodology of this litigation between copyright law and antitrust law is for some aspects different with the European one ; its sensibility for the particular juridical nature of copyright is sometimes a source of ambiguity. To restore this litigation its real dimension, it could be possible to consider it as a part of « regulation law », that?s to say the law of the articulation between social subsystems and juridical suborders. To give to this type of litigation a general interest finality, and not only a submission of copyright under economic laws, it would be necessary to create specific « regulating bodies (instances)», like the recent French « Board of artistic and literary property » (« Conseil supérieur de la propriété littéraire et artistique »), a collaboration between different regulating bodies, to ensure a full consideration of the various types of interests and of the merchant and not merchant values.
