La conciliation entre les impératifs de sécurité alimentaire et la liberté du commerce dans l'accord SPS

Mai-Anh Ngo

Revue internationale de droit économique, 2007, vol. t. XXI, 1, issue 1, 27-42

Abstract: The actual, SPS agreement allows a limited taking into account of the food safety requirements. The room for man?uvre of the States is relatively restricted, in particular because of the central place conferred on the scientific justification when evaluating the validity of sanitary measures. However, in the future, a new balance can be found between the requirements of food safety and the free trade, in particular by reconsidering the role of science in SPS agreement.
