Droit du commerce international et sécurité alimentaire

Clotilde Jourdain-Fortier and Éric Loquin

Revue internationale de droit économique, 2012, vol. t. XXVI, issue 4, 21-47

Abstract: Do international trade law favors world food insecurity ? Answers to such a matter oppose to some in the others. Some lean against WTO and develop arguments in favor national food security policies only to reach food self-sufficiency. Others excessively preach merits of free trade, forgetting that meanwhile international trade in agriculture and food rises in the world, famines keep on killing every day. Such a dialectical relationship between those two ways of thinking does not supply adequate answers at present. On the contrary, these theses need to combine to supply right answers which could solve ? or decrease ? food insecurity problems. WTO substantive law hardly tries to realize a compromise. The Agreement on Agriculture in particular, but not only, provides States with flexibility to allow them to meet their international trade obligations with the pursuit of food security ? and their right to food. Unfortunately, this compromise remains insufficient. The time has come to make the international trade institution participates to better social justice in the world. Some tools exist but must be revised, others are to be imagined.
