Abstract: A global issue : food system, environmental protection, and human rights. However, there is no general answer yet, from a legal point of view. This topic is hardly dealt by States. Moving from food crisis to food sovereignty is a major scope; but this goal is still far from being achieved currently. Even so, food safety has become a main topic of commercial speech of companies. Some of them have pointed their general speech toward corporate and social responsibility (hereafter CSR). That is the problem : is food safety the responsibility of private actors ? Is it a way forward on this issue as decisive as complex ? These questions reveal the ambivalence of private actors. Those can provide interesting initiatives and we cannot deny it. But we remain skeptic. Most companies maintain a shareholder conception about profit and profitability. So, private wealth is rarely redistributed from the perspective of improving food safety. Firstly, this article aims to observe practices of banking and commercial companies. Secondly, it assesses the effectiveness of corporate and social responsibility. This observation raises some critics. We consider that private initiative must remain a support of state intervention. In all cases, it reveals the need for a legal regulation of food safety.
