Abstract:
The sustainability of the property rights enounced in the Civil Code contrasts with the evolution of its content. The promotion of self-interest is seen today in opposition to the protection of the public interest. This contradiction in the legal field of property rights, must be better overriden an adaptation of its legal regime than the promotion the collectivization of property, which was historically the first proposal. It is proposed to consider the possible articulation of the property rights of the owner with those of a third interest (stakeholder) by the technique of real rights, contract and allocation of goods. To overcome the problem of collective ownership in recent decades, the commons, and world heritage allocation was promoted. These concepts underline the desire to establish and formalize the search for common engaging owners as stakeholders alongside.
