L’identification de l’employeur

Abstract:
Business concepts and subordination allowed the judge to isolate the employer inside the complex business organization. However, the evolution of the concept of business has brought about the collapse of jurisprudential constructions which served to establish the existence of an employment contract and consequently to identify the employer. This problem threatens the labour law to its foundations. To remedy this we propose in this study a dynamic definition of the concept of employer and a plea for more recognition of the economic dependence.
