La procédure dans les droits de propriété intellectuelle

Abstract: The functions of the procedure are more diverse for industrial property rights than for copyright and neighboring rights, due to the existence a registration proceeding before national or supranational Offices. Industrial property rights know two types of procedures: procedures for the granting and post granting procedures. Qualification of ?administrative procedure? for granting proceedings is improper as many of them are close to normal judicial proceedings and differ only by the fact that bodies internal to Offices deal with them. The latter are essentially identical to judicial procedure under ordinary law and differ only for the sake of efficiency in the fight against counterfeiting.
