Les fonctions de la procédure en droit bancaire et financier

Revue internationale de droit économique, 2015, vol. t. XXIX, issue 4, 503-512
Abstract:
If the procedure has received growing attention in the banking and financial sector, its role is nonetheless complex. Indeed, the procedure performs very different functions: first it ensures the legitimacy of norms and sanctions; it is then exploited by national and international regulators, who use the procedure as a way of leveling practices and structures among economic operators. Furthermore, the procedure has become a true instrument of structural governance that obscures important questions unanswered: what is the legitimacy of these procedural rules, both at the stage of their sources that their sanction?
