La normativité au pluriel: dépasser le prisme de la concurrence, construire des méthodes de combinaison

Abstract:
The existence of competing normativities can be understood by means of combination methods. Based on the example of the ?FRAND license? standard for patents?essential to a technical norm?, this contribution proposes to discuss three stages of reasoning. The first justifies the combination of normativities by the incompleteness of the normative process. The second shows that the combination of normativities is due to the existence of a circulation phenomenon that is often not very explicit. The third tries to highlight that the combination of normativities inevitably produces a hybridization phenomenon.
