Quand le tiers est aux abonnés absents: à la recherche des institutions perdues

Abstract:
The emergence of management in the space of legal normativity subverts the principles according to which social actions are supposed to be submitted to a legal order. The effectiveness of this order is guaranteed by the principle according to which ignorance of the law is no excuse. This efficacy ultimately relies on the monopoly of legitimate power endowed in the state. Theory allows us to account for the reasons why such transgressions occur, as well as the forms of conflicts and managerial norms that result from them. Uncertainty generated by these evolutions corresponds to a crisis of legitimacy of the social institutions that organize the system of conflict resolution of the society considered, be it the confusion between the public and the private or the consequences of globalization. Henceforth, the issue is no longer solely about knowing ?how institutions think? but about ?how we might understand the nature of institutions.?
