Abstract:
Being the final product of arbitration proceedings, an arbitral award may be appealed to the arbitrator who made it or to the state court that controls it. Traditional teaching indicates the impossibility of appeals against this award and that these appeals fall within the public order, such that parties cannot contravene the rules that govern appeals. However, the present study shows that the will of the parties to arbitration is being increasingly taken into consideration, and that international trade actors should be informed of this development, so as to better protect themselves.
