Abstract:
Bernard Remiche often denounced the misuse of infringement procedure as a commercial ?weapon of domination.? This phenomenon, which is not, in our opinion, a marginal one, is significantly undervalued and constitutes a real problem for the practice of law because intellectual property law can easily be abused. The purpose of his paper, beyond simply raising awareness of this phenomenon, is to suggest some ways in which the law can fight against this issue.
