Abstract: The French Law n ° 2017-399 of March 27, 2017, on the Corporate Duty of Vigilance marks the renewed apprehension by law of the ethical procedures of companies. The institutionalization of ethical initiatives results first of all in the mobilization of corporate self-regulation for the development of the vigilance process. It is also made visible by the place offered to dialogue with stakeholders within the legal framework. However, the current weaknesses of companies? ethical initiatives undermine the effectiveness of vigilance obligations. A reinforced judicial control of vigilance constitutes the main lever of an articulation between ethical responsibility and liability bearing effects on the protection of the environment by the company.
