Abstract:
The study of the scope of application of the law relating to the economic action of public persons is particularly necessary, as much because it sheds light on the relationship of public law with the market as because it leads to addressing a question essential to the action of all public authorities. If the notion of economic activity in particular has been able to draw limits to the scope of the law relating to the economic action of public persons, it is necessary to show how it is now outdated in order to propose a new meaning of the criterion that is likely to limit this field of application.
