Abstract:
The public authorities allowed the social partners to actively participate to the drawing up of the labor law by granting them a power of initiative. For a long time, the distribution of the work between public authorities and social partners appeared relatively harmonious. Since a few years, this cooperation seems to be more complicate so that the two parties are often in competition. This implies that some labor regulations are of poor quality. It is thus useful to think about a regulating process in order to avoid such consequence, without depriving the social partners of their power of initiative.
