Abstract:
The specialized literature defines civil action as being: “the legal means used by a person in order to ask the court to recognize its right or to fulfil this right, by ending the obstacles put by another person or through an adequate compensation Irrespective of its definition method, civil action is considered a central institution around which the entire activity of the court of law and of the parties gravitates. Next, we will discuss the requirements for exercising civil action: expression of a subjective right; justification of an interest to act; existence of the capacity of exercise and; the existence of party in a law suit quality.
