Recess, Rescission and Invalidation of the Administrative Documents

Abstract: The recess of the administrative documents supposes the temporary, provisional cessation of the administrative documents and can be disposed when there is a doubt, an incertitude regarding the lawfulness and opportunity of an administrative document. The recess can be realized by the issuing organ, by the superior hierarchic body and not by the trial instance. The rescission of the administrative documents appoints the juridical operation through which the issuing body disposes that the withdrawal of its own document to be as result of the disposals of the superior hierarchic body. In case that, principally, administrative documents are revocable, there are also exceptions from this rule, concerning individual administrative documents, the normative ones being always revocable.
