Abstract: The article is devoted to the formation order and functions of the Bundesrat in the legislative process of Germany. It is discovered the features of the Bundesrat’s status and its participation in the discussion and adoption of laws of different categories. It is paid particular attention to the role of the Bundesrat in balancing interests of the Federation and the states as well as in defending the interests of the states at the federal level.
