Reflexiones en torno a la economía del delito

Abstract: En este documento se reflexiona acerca de la comisión de delitos. Los actores se determinan en función de la legitimidad, es decir, con dolo o sin el en resultado de la defensa de vida vienes y honra. Se asume metodológicamente que el hecho delincuencial es racional en tanto que persigue un lucro y está determinado por un cálculo intuitivo del riesgo, así como por la posibilidad de tener una retribución suficiente estimada como ingresos esperados. En esta lógica se puede asumir que existe una igualdad por parte del actor legítimo quien decide enfrentar o no al delincuente justipreciando su riesgo también de manera intuitiva. A esta ecuación de equilibrio entre lo legítimo e ilegítimo el Estado responde con políticas las cuales tienen dos extremos: una ejecutada por la institución especializada o mediante la participación de los ciudadanos. Se pretende reflexionar acerca de una posible alternativa para que el mix de las políticas gane en eficacia y eficiencia. ****** This paper reflects on the crime. The actors are determined based on legitimacy, that is, intentionally or not the result of defend of property, life and honor. Methodologically assumes that the criminal act is rational while chasing a profit and is determined by an intuitive risk calculation, as well as the possibility of having a sufficient remuneration estimated as expected revenues. In this logic we can assume that there is an equality by the legitimate actor who decides to confront the offender assessing their risk also intuitively. This equation of balance between the legitimate and illegitimate state responds with policies which have two ends: one carried out by the specialist institution or by involving citizens. Some thoughts about a possible alternative for the mix of political gain in effectiveness and efficiency.
